Terms & Conditions

These Terms apply to your use of the ClearPath Assessments website and matching service (the “Service”). The Service is operated by Your Wits Pty Ltd (ABN 91 667 707 566) trading as “ClearPath Assessments” (“ClearPath”, “we”, “us”, “our”). By using the Service you agree to these Terms.

1. What ClearPath does — and does not do

ClearPath is a matching service. We connect people seeking psychology, educational, and speech pathology assessments with independent, qualified providers across Australia. We do not deliver assessments, provide clinical advice, or supply healthcare services of any kind. All assessment services are delivered by the matched provider, who is an independent practitioner solely responsible for their own clinical care.

When you submit an enquiry, we use the information you give us to identify a suitable provider near you and to introduce you. The provider then contacts you directly to arrange and book the assessment. The professional relationship — and any clinical, contractual, and payment arrangements — is between you and the provider.

2. The matching service we provide

We do not guarantee that a suitable provider will be available in every location or within a particular timeframe. Where a match is not immediately available (for example, outside our current face-to-face coverage), we may add your enquiry to a waitlist and contact you when coverage expands.

3. Assessment services are provided by the provider

The provider you are matched with is solely responsible for:

ClearPath is not a party to the engagement between you and the provider and does not control how the assessment is delivered.

4. Pricing and payment

You pay the provider, not ClearPath. Each provider sets their own fees. The provider will confirm the fee, deposit requirements, balance due dates, and accepted payment methods (and any associated card surcharges) before you book. ClearPath does not collect payment from consumers and does not handle consumer payment details.

As a general guide only, assessments on our network typically fall within these ranges. Actual fees vary by provider, complexity, and inclusions:

Funding. ClearPath treats all assessments as private-pay and never bills Medicare, the NDIS, or any funding body. Any Medicare rebate or NDIS arrangement is handled directly between you and your provider.

5. Booking changes, cancellations, and refunds

Cancellation, rescheduling, and refund terms are set by the provider and form part of your agreement with them. The provider will give you their policy before you book. Any refund request must be raised with the provider, who is solely responsible for processing it.

Providers may also need to change the date, time, or format of an appointment due to unforeseen circumstances. In that case the provider will contact you directly.

6. Provider verification

Before adding a provider to our network we check their registration with the relevant Australian regulator and review their practice details. Verification is a registration and credentialing check — it is not an endorsement of clinical competence, suitability for your specific needs, or assessment outcome, and we do not supervise providers' clinical work.

Providers who hold an account on the Service are responsible for keeping their credentials confidential and for all activity under their account. We may suspend or terminate access where we reasonably suspect a breach of these Terms or the network's standards.

9. Privacy

How we collect, use, store, and share your information is explained in our Privacy Policy. By using the Service you acknowledge that policy. In particular, when we match you with a provider we share your enquiry (including relevant health context and your contact details) with that provider so they can contact you.

10. Intellectual property

The ClearPath Assessments name, brand, website content, and underlying systems are owned by Your Wits Pty Ltd or our licensors. Using the Service does not transfer any of those rights to you. You may not copy, scrape, reproduce, or republish our content without our written permission.

11. Third-party links and content

Our website may link to third-party sites for convenience. Those links are not an endorsement, and we are not responsible for the content, privacy practices, or availability of third-party sites. Information on our website is provided for general information only and is not clinical advice.

12. No medical or clinical advice

Nothing on the Service is medical, psychological, or clinical advice. The Service does not diagnose, treat, or assess any condition. For clinical advice, please speak with a qualified health professional — the matched provider is the appropriate point of contact for questions about an assessment.

13. Force majeure

We are not liable for any failure or delay in providing the matching service caused by events beyond our reasonable control, including fire, flood, storm, earthquake, pandemic, power or network outage, industrial action, or acts of government.

14. Limitation of liability

To the extent permitted by law, ClearPath's liability is limited to providing the matching service described in these Terms. We are not responsible for the clinical care, conduct, outcomes, reports, or fees of any matched provider, or for any loss arising from the engagement between you and the provider. Nothing in these Terms limits any non-excludable rights or guarantees you have under the Australian Consumer Law.

15. Account security and notifications

We do not store payment card details — providers handle payment directly with you. If you receive an unexpected payment request claiming to be from ClearPath, please verify it with us before acting on it.

16. Complaints

About the matching service or our website (for example, a technical issue, a problem with how you were matched, or a privacy concern): please contact complaints@clearpathassessments.com.au.

About the assessment service itself (clinical care, the report, the fee, or the booking experience): please raise it with the provider directly. If you would like our help passing it on, we will forward it to the provider on request. Unresolved complaints about a registered practitioner can also be made to AHPRA or, for speech pathologists, to Speech Pathology Australia.

17. Changes to these Terms

We may update these Terms from time to time. The latest version will always be available on this page with the “last updated” date at the top. Continued use of the Service after an update constitutes acceptance of the updated Terms.

18. Governing law

These Terms are governed by the laws of New South Wales, Australia. You and ClearPath submit to the non-exclusive jurisdiction of the courts of New South Wales.
